1. Acceptance of Terms

Welcome to Davis Rural Broadband Inc. (“DRB,” “we,” “us,” or “our”). By accessing or using our website at davisbroadband.com, creating an account, purchasing hardware, or subscribing to our internet service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

We may update these terms from time to time. Changes take effect when posted on this page, with the updated effective date shown at the top. Continued use after changes constitutes acceptance of the revised terms.

2. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use our services. By creating an account, you represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these terms.

3. Service Description

DRB provides fixed-wireless 5G/LTE internet service to rural communities, primarily in Mercer County, Pennsylvania and surrounding areas. Our service uses wireless technology transmitted from towers to customer premises equipment (CPE). Actual speeds, latency, and reliability depend on factors including distance from the tower, terrain, foliage, weather, and network congestion.

Service tiers include DRB Premium (up to 200 Mbps download / 20 Mbps upload) and DRB Extreme (up to 500 Mbps download / 50 Mbps upload). Advertised speeds represent maximum capabilities and are not guaranteed minimums.

Our hardware kits (DRB HOME, DRB PRO, and DRB ELITE) are sold as standalone purchases that you own outright. The antenna, router, and any included accessories remain your property after purchase.

4. Coverage and Availability

Service is available only within our active coverage footprint, which currently includes Greenville, Fredonia, Jamestown, Transfer, Clarks Mills, and surrounding rural communities in western Pennsylvania. Coverage is confirmed on a per-address basis through our Coverage Checker.

Service availability is not guaranteed at any specific address until confirmed by our system or a technician site survey. We may expand, reduce, or reconfigure our network coverage at any time without notice.

5. Payments, Billing, and Refunds

Hardware kits are charged at the time of purchase. Monthly service fees are billed in advance on a recurring basis starting from the date of activation. We accept major credit and debit cards (Visa, Mastercard, American Express, Discover) and ACH bank transfers.

Payments are processed through Square, Inc. By providing payment information, you authorize us and Square to charge your selected payment method for all amounts due.

All prices are in U.S. dollars and do not include applicable taxes, which will be calculated and added at checkout based on your billing address.

14-Day Money-Back Guarantee: If you are not satisfied with DRB service, you may return your hardware kit within 14 days of delivery for a full refund of the hardware purchase price. We will also refund any service fees paid during the trial period. To initiate a return, contact our support team. We will provide a prepaid return shipping label. Refunds are processed within 5–10 business days of receiving the returned equipment in acceptable condition (normal wear excepted).

6. Subscription, Cancellation, and Changes

DRB service is offered on a month-to-month basis with no long-term contract, no credit check, and no early termination fees.

You may cancel your service at any time from your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing cycle. You will not be charged for any subsequent billing periods.

You may pause your service at any time for seasonal or temporary absence. Service resumes at the start of your next billing cycle upon reactivation.

You may upgrade or downgrade your plan at any time from your account dashboard. Changes take effect at the start of your next billing cycle. There are no fees for switching plans.

7. Acceptable Use Policy

You agree to use DRB service only for lawful purposes and in compliance with all applicable laws and regulations. You may not:

•  Use the service to transmit unlawful, threatening, defamatory, obscene, or harassing content;
•  Engage in spam, phishing, malware distribution, or other malicious activity;
•  Attempt to gain unauthorized access to our network, systems, or other customers' accounts;
•  Resell, redistribute, or share your service with non-household parties without our written consent;
•  Use the service in a manner that unreasonably interferes with other customers' access or degrades network performance;
•  Circumvent any usage monitoring, bandwidth shaping, or security measures we implement;
•  Run automated systems that consume disproportionate network resources (e.g., large-scale file sharing nodes, cryptocurrency mining over the connection).

We reserve the right to suspend or terminate service for violations of this policy.

8. Data Usage and Network Management

Both DRB Premium and DRB Extreme plans include unlimited data with no overage charges. We do not impose hard data caps.

To maintain network quality for all customers, we may apply network management practices during periods of congestion. DRB Extreme subscribers receive priority access, which means their traffic is less likely to be deprioritized during peak hours. These practices are content-neutral and do not target specific applications or protocols.

9. Equipment and Installation

You are responsible for the safekeeping and proper operation of your DRB hardware kit. Damage caused by misuse, unauthorized modification, or negligence is not covered under any warranty.

DRB HOME and DRB PRO kits are designed for self-installation. DRB ELITE includes professional installation at no additional charge. If you decline professional installation for an ELITE kit, you assume full responsibility for proper placement and performance.

If your kit arrives damaged, contact us within 48 hours of delivery for a free replacement.

Returned equipment must include all original components, cables, and accessories. Missing parts may result in a partial refund deduction.

10. Disclaimers and Limitation of Liability

DRB SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, secure, or available at any particular speed. Network performance depends on factors outside our control, including weather, terrain, and third-party infrastructure.

To the fullest extent permitted by law, Davis Rural Broadband Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the total amount you paid to DRB in the 12 months preceding the event giving rise to the claim.

11. Termination

You may terminate your service at any time as described in Section 6.

We may suspend or terminate your service immediately, without notice, if you violate these terms, engage in fraudulent activity, fail to pay amounts due after reasonable notice, or if continued provision would violate law or regulation.

Upon termination, your right to use the service ceases immediately. You remain liable for all charges incurred prior to termination.

12. Governing Law and Disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

Any dispute arising from these terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved through binding arbitration in Mercer County, Pennsylvania, under the rules of the American Arbitration Association. You waive any right to participate in class actions.
